Terms of Service

These Terms of Service govern your use of ASL Dating. By using the app, you agree to these terms. Please read them carefully.
## ✅ 1. Eligibility
To use ASL Dating, you must:
- Be at least 18 years of age at the time of registration
- Be physically located in and a resident of the United States. ASL Dating is offered only within the United States and is not available to users outside the United States
- Verify your identity by completing SMS phone verification with a valid U.S. mobile phone number you control
- Provide accurate, truthful, and complete information on your profile
- Not be prohibited from receiving services under applicable U.S. federal, state, or local law
- Not be subject to any court order, criminal sentence, probation or parole condition, civil commitment, sex-offender registration requirement, or other legal restriction that prohibits or limits you from using online dating platforms, contacting other adults via internet services, or otherwise from using a service like ASL Dating. By way of example and not limitation, if you are required to register as a sex offender in any jurisdiction, are subject to a no-contact order, or are otherwise legally restricted from using internet-based platforms to meet other people, you are NOT eligible to use ASL Dating
- Not have been previously banned or permanently removed from ASL Dating
- Not have had your phone number blocked by ASL Dating from creating new accounts
We reserve the right to verify your eligibility at any time and to suspend or terminate your account if we determine that you do not meet these requirements.
## 👤 2. Your Account & Responsibilities
You are solely responsible for your account and all activity that occurs under it:
- You may only create and maintain one account per person
- You must not share your account with, or transfer your account to, any other person
- You are solely responsible for maintaining the security of your sign-in credentials
- You must notify us immediately at legal@asldatingapp.com if you believe your account has been compromised
- Impersonating another person, creating fake profiles, or misrepresenting your identity is strictly prohibited and may result in criminal liability
- You are solely responsible for all content you post, messages you send, and interactions you engage in through the Service
## 🚫 3. Prohibited Conduct
The following behaviors are strictly prohibited on ASL Dating and may result in immediate permanent suspension and referral to law enforcement:
- Sending, requesting, or displaying explicit, sexual, or inappropriate content
- Harassment, bullying, threatening, stalking, or abusive behavior toward any user
- Soliciting or sharing personal financial information, bank details, or requesting money
- Using bots, scrapers, scripts, or any automated tools to access or interact with the Service
- Attempting to reverse engineer, hack, decompile, or compromise the app or its infrastructure
- Recording, distributing, or sharing any video call or private communication without explicit written consent from all parties
- Sharing another user's private information, photos, or videos without their consent (doxxing)
- Engaging in fraud, scamming, romance scamming, catfishing, or any form of deceptive behavior
- Discriminating against, harassing, or targeting users based on disability, race, religion, gender, sexual orientation, or any protected characteristic
Violations will result in immediate account suspension, permanent ban, phone-number blocking, and may be reported to law enforcement authorities.
## ⚖️ 4. No Responsibility for Member Conduct
ASL Dating is a platform that connects users. We do not screen, verify (beyond phone confirmation), supervise, direct, or control the conduct of our members.
- ASL Dating is not responsible for the behavior, actions, statements, or conduct of any member, whether within the app, during a live video call, or in any in-person or offline interaction
- ASL Dating is not responsible for any harm, injury, loss, or damage — physical, emotional, mental health, financial, or otherwise — arising from your interactions with other users, whether on or off the platform
- Meetings arranged through ASL Dating are entirely at your own risk. ASL Dating bears absolutely no responsibility for what occurs between users once they leave the platform. You assume full and sole responsibility for all off-platform interactions. ASL Dating strongly recommends meeting in public places and informing trusted friends or family of your plans
- ASL Dating does not endorse, guarantee, or verify any representations made by members about themselves, their identity, intentions, or character
- Any dispute between users is solely between those users. ASL Dating has no obligation to intervene, mediate, or take sides in any such dispute
- We reserve the right — but are not obligated — to monitor, review, or take action regarding user conduct
**BY USING ASL DATING, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT ASL DATING BEARS NO LIABILITY WHATSOEVER FOR THE CONDUCT OF ANY MEMBER, INSIDE OR OUTSIDE OF THE APP.**
## 📜 5. Disclaimer of Warranties & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, ASL Dating expressly disclaims all warranties, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Any warranty that the Service will be uninterrupted, error-free, or secure
- Any warranty regarding the accuracy, reliability, or completeness of any content
To the maximum extent permitted by law, ASL Dating, its officers, directors, employees, agents, partners, and affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, punitive, or exemplary damages
- Loss of profits, revenue, data, goodwill, or business opportunities
- Personal injury, emotional distress, or property damage resulting from your use of the Service or interactions with other users
- Any harm arising from unauthorized access to or alteration of your transmissions or data
- Any conduct or content of any third party on the Service
Our total aggregate liability to you for any and all claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total amount you paid to ASL Dating in the 12 months preceding the claim, or (b) $100 USD.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
## 🔐 5b. Cybersecurity, Data Breaches & Unauthorized Access
ASL DATING IMPLEMENTS INDUSTRY-STANDARD SECURITY MEASURES BUT CANNOT GUARANTEE ABSOLUTE SECURITY OF YOUR DATA OR THE SERVICE. BY USING ASL DATING, YOU ACKNOWLEDGE AND EXPRESSLY AGREE TO THE FOLLOWING:
- **No Guarantee of Security:** ASL Dating does not warrant that the Service, its servers, or any data transmitted to or from the Service is free from viruses, malware, cyberattacks, or other harmful components
- **Data Breaches:** ASL Dating shall not be liable for any unauthorized access to, disclosure of, alteration of, or destruction of your personal data resulting from a data breach, cyberattack, hacking, ransomware, or any other unauthorized third-party intrusion, regardless of the cause
- **Hacking & Cybercrime:** ASL Dating bears no responsibility or liability for any harm, loss, damage, or expense — including financial loss, identity theft, emotional distress, or reputational harm — arising from hacking, phishing, social engineering, man-in-the-middle attacks, malware, spyware, or any other form of cybercrime perpetrated by third parties against the Service or your account
- **Third-Party Attacks:** In the event that a malicious actor, hacker, cybercriminal, or unauthorized third party gains access to the Service's systems or user data, ASL Dating shall not be held liable to you or any third party for damages of any nature arising from such incident
- **User Device Security:** You are solely responsible for maintaining the security of your own device, mobile phone number, SMS access, and any credentials used to access the Service. ASL Dating is not responsible for any breach resulting from vulnerabilities on your personal device, SIM swapping, lost or stolen phones, or unauthorized access to your SMS messages
- **Force Majeure & Cyberattacks:** Service interruptions or data loss caused by cyberattacks, distributed denial-of-service (DDoS) attacks, ransomware, state-sponsored attacks, or other events beyond our reasonable control shall not constitute a breach of these Terms by ASL Dating, and ASL Dating shall bear no liability for any resulting harm
- **Notification Effort:** In the event of a confirmed data breach that materially affects your personal information, ASL Dating will make reasonable commercial efforts to notify affected users within 72 hours of discovery, where technically feasible. However, failure to provide timely notice shall not create additional liability for ASL Dating
- **No Liability for Cybercrime Losses:** ASL Dating shall not be liable for any financial loss, identity theft, fraud, or any other damages resulting from cybercrime, including but not limited to phishing attacks that impersonate ASL Dating, fraudulent emails or messages purporting to be from ASL Dating, or unauthorized transactions made using your account credentials
YOU EXPRESSLY WAIVE ANY AND ALL CLAIMS AGAINST ASL DATING ARISING FROM DATA BREACHES, HACKING INCIDENTS, CYBERATTACKS, OR ANY OTHER FORM OF UNAUTHORIZED THIRD-PARTY ACCESS TO THE SERVICE OR YOUR DATA, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
If you do not accept this risk, you should not use the Service.
## 🛡️ 5c. Security Team Review — No Legal Obligation or Liability
ASL DATING MAINTAINS A SAFETY AND SECURITY TEAM AS A COURTESY TO ITS USERS. THE EXISTENCE OF THIS TEAM DOES NOT CREATE ANY LEGAL OBLIGATION, DUTY OF CARE, OR LIABILITY ON THE PART OF ASL DATING. By using the Service, you expressly agree to the following:
- **No Obligation to Review:** ASL Dating is under no legal obligation to review, investigate, act upon, or respond to any user report, complaint, flagged content, or security concern submitted through the app or any other channel
- **No Guarantee of Action:** The submission of a report to ASL Dating's safety or security team does not guarantee that any review, investigation, or corrective action will be taken, or that any such action will occur within any particular timeframe
- **Delayed or No Response:** Failure by ASL Dating's safety or security team to review, respond to, or act upon any report — regardless of the severity of the reported conduct — shall not constitute negligence, breach of contract, breach of duty of care, or any other cause of action against ASL Dating
- **No Duty of Care:** ASL Dating does not assume any duty of care toward users based on the existence of its safety team, reporting tools, moderation systems, or any other safety feature offered through the Service
- **Discretionary Action:** All decisions made by ASL Dating's safety or security team regarding reports, content moderation, account suspensions, or any other safety-related matters are entirely discretionary. ASL Dating reserves the sole right to determine what action, if any, to take in response to any report or concern
- **Errors in Judgment:** ASL Dating shall not be liable for any harm resulting from safety team decisions, including mistaken account suspensions, failure to suspend an account that later causes harm, delayed response to a report, or incorrect assessment of reported conduct
- **No Lawsuit for Inaction:** You expressly agree that you will not file, initiate, or pursue any lawsuit, arbitration claim, regulatory complaint, or any other legal proceeding against ASL Dating arising from or related to the safety or security team's failure to review, act upon, or respond to any report, complaint, or safety concern in a timely or satisfactory manner
- **Stated Response Times Are Estimates Only:** Any reference to response times (such as "within 72 hours") within the app, these Terms, or any other ASL Dating communication is an estimate only and does not constitute a binding commitment. Failure to meet any stated response time shall not give rise to any legal claim against ASL Dating
- **Third-Party Harm After Report:** If you submit a report regarding another user and that user subsequently causes harm to you or any other party before, during, or after the review period, ASL Dating shall not be liable for such harm, regardless of whether ASL Dating had actual or constructive knowledge of the reported conduct
- **Good Faith Effort:** ASL Dating's safety team operates on a good faith, commercially reasonable effort basis only. This effort does not create a warranty, guarantee, or legal duty of any kind
BY SUBMITTING ANY REPORT TO ASL DATING, YOU ACKNOWLEDGE AND AGREE THAT ASL DATING'S FAILURE TO REVIEW OR ACT UPON SUCH REPORT — FOR ANY REASON, INCLUDING HUMAN ERROR, SYSTEM FAILURE, HIGH REPORT VOLUME, OR STAFFING LIMITATIONS — SHALL NOT CONSTITUTE A BASIS FOR ANY LEGAL CLAIM, LAWSUIT, REGULATORY ACTION, OR LIABILITY AGAINST ASL DATING OR ANY OF ITS OFFICERS, EMPLOYEES, OR AGENTS.
## 💼 6. Indemnification
You agree to defend, indemnify, and hold harmless ASL Dating and its officers, directors, employees, agents, licensors, partners, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorney's fees, court costs, legal fees, expert witness fees, and all other litigation-related expenses) arising from or related to:
### 6a. Internal Platform Activity
- Your use of or access to the Service, including all features, tools, and communications within the app
- Your violation of any provision of these Terms
- Any content you submit, post, transmit, or display through the Service, including profile information, messages, and any other user-generated content
- Your conduct or interactions with other users while using the Service, including during live video calls, text chats, or any other in-app communication
- Any misrepresentation, fraud, or impersonation you engage in while using the Service
- Any claims brought by other users arising from your behavior, statements, or actions within the app
- Any harm, injury, or damage caused to another user through your use of the Service's features
### 6b. External & Offline Activity
- Any interactions, meetings, communications, or conduct between you and another user that occurs outside of or beyond the ASL Dating platform, including but not limited to in-person meetings, phone calls, text messages, social media contact, or any other off-platform communication
- Any physical, emotional, financial, reputational, or other harm arising from your decision to meet, contact, or engage with another user outside of the app
- ASL Dating bears absolutely no responsibility for what occurs between users once they leave the platform. You assume full and sole responsibility for all off-platform interactions
- Any criminal conduct, harassment, assault, fraud, or other illegal activity you engage in against another user, whether on or off the platform
- Any harm you suffer as a result of sharing your personal contact information, location, or other private details with another user
### 6c. Third-Party Claims & Legal Actions
- Your violation of any third-party rights, including privacy, publicity, intellectual property, or other proprietary rights
- Any claims brought by third parties arising from your use of the Service
- Your violation of any applicable law, regulation, rule, or court order
- Any regulatory investigation, government inquiry, or legal proceeding initiated as a result of your conduct on or off the platform
- Any claims arising from content you shared that is defamatory, obscene, unlawful, or harmful to third parties
### 6d. User Responsibility for ASL Dating LLC's Legal Fees & Costs
If any lawsuit, claim, legal action, arbitration proceeding, regulatory investigation, or other legal proceeding is brought against ASL Dating LLC — whether by you, another user, a third party, or any government authority — arising from or related to your conduct, your use of the Service, your off-platform interactions with other users, or your violation of these Terms, you shall be personally and fully responsible for paying all of ASL Dating LLC's legal fees and costs.
This includes but is not limited to:
- All attorney's fees and legal counsel costs incurred by ASL Dating LLC in defending against or responding to any such claim or proceeding
- All court filing fees, administrative fees, and arbitration fees
- All expert witness fees, investigative costs, and third-party consultant fees
- All costs associated with discovery, depositions, document production, and any other litigation-related activities
- Any settlement amounts paid by ASL Dating LLC to resolve any such claim
- Any judgment amounts awarded against ASL Dating LLC in connection with such claim
- All costs incurred whether or not the proceeding results in a final judgment, and whether or not ASL Dating LLC is ultimately found to be at fault
You acknowledge and agree that this obligation to cover ASL Dating LLC's legal fees and costs is unconditional, survives the termination of your account and these Terms indefinitely, and is binding upon your heirs, successors, and assigns. You waive any right to claim that such fees or costs are unreasonable or disproportionate.
## ⚖️ 7. Dispute Resolution & Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
You and ASL Dating agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved as follows:
- **Informal Resolution First:** Before filing any formal claim, you agree to contact us at legal@asldatingapp.com and attempt to resolve the dispute informally for at least 30 days
- **Binding Arbitration:** If informal resolution fails, disputes shall be resolved through binding individual arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules
- **No Class Actions:** You waive any right to participate in a class action lawsuit or class-wide arbitration against ASL Dating
- **Governing Law:** These Terms are governed by the laws of the United States and the State of Utah, without regard to conflict of law provisions
- **Venue:** Any disputes not subject to arbitration shall be resolved exclusively in the federal or state courts located in Utah
- **Time Limit:** Any claim must be brought within one (1) year of the event giving rise to the claim, or it is permanently waived
## 💳 8. Subscriptions & Payments
ASL Dating offers optional paid subscriptions processed exclusively through Apple App Store and Google Play:
- Subscriptions auto-renew unless cancelled before the renewal date. You can cancel any time up to the last day before renewal — the subscription will remain active through the end of the current billing period.
- All pricing is in USD and may vary by region based on platform pricing policies
- Payments are processed solely by Apple or Google — ASL Dating does not store your payment information
- Subscription fees are non-refundable except as required by Apple or Google's refund policies
- Super Like packs and the Unlimited Super Likes monthly subscription are non-refundable once purchased. Cancelling the Unlimited subscription stops future renewals but does not refund the current billing period.
- To cancel, manage your subscription through your device's App Store or Google Play settings
- If your account is suspended or terminated for violating these Terms, you are not entitled to a refund of any subscription fees paid
## ©️ 9. Content & Intellectual Property
You retain ownership of content you post, but grant ASL Dating a worldwide, royalty-free, non-exclusive, perpetual, sublicensable, and transferable license to use, copy, modify, display, distribute, publish, perform, and create derivative works from your content for any of the following purposes: (a) operating, providing, and improving the Service; (b) marketing, advertising, and promoting ASL Dating, including in app-store listings, social media, websites, press materials, and any other promotional channels; and (c) any other commercial or non-commercial purpose related to the Service or to the promotion of ASL Dating, in any medium now known or later developed. You agree that ASL Dating is NOT obligated to compensate you in any form (monetary or otherwise) for any such use of your content, including marketing or promotional use, and that you waive any right to royalties, residuals, or other compensation. You agree that:
- All photos you upload must authentically represent yourself
- You have full legal right to use any content you post
- You will not post copyrighted material without permission
- ASL Dating may remove any content that violates these Terms without notice
- ASL Dating's name, logo, brand, and design are proprietary and may not be used without written permission
## 🔚 10. Termination
ASL Dating reserves the right to suspend or permanently terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination:
- Your right to access the Service immediately ceases
- Your phone number may be permanently blocked from creating new accounts
- No refund of any subscription fees shall be issued
- All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability
## ✏️ 11. Changes to Terms
ASL Dating reserves the right to modify these Terms at any time. When we do:
- We will notify you via in-app notification when changes take effect
- Continued use of the app after changes take effect constitutes your acceptance of the revised Terms
- Material changes will require your explicit re-acceptance before you can continue using the Service
- If you do not agree to the revised Terms, you must stop using the Service and delete your account
## 🔍 12. No Background Checks or Identity Verification
ASL DATING DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS, IDENTITY VERIFICATION (BEYOND SMS PHONE VERIFICATION), OR ANY OTHER FORM OF SCREENING ON ITS USERS. By using the Service, you expressly acknowledge and agree:
- ASL Dating does NOT perform criminal background checks of any kind, including but not limited to checks against the National Sex Offender Public Website, FBI databases, state sex offender registries, court records, immigration records, or any other public or private criminal database
- ASL Dating does NOT verify users' real names, addresses, employers, marital status, financial history, immigration status, education, occupation, or any other personal claims made by users in their profile or messages
- Phone number verification is performed solely to deter automated bots — it does not establish a user's legal identity, age, or intent
- Age is established solely by the birthdate the user provides at sign-up; ASL Dating cannot and does not guarantee that any user is the age they claim to be
- You are solely responsible for evaluating the identity, character, age, intentions, and safety of any user you interact with
- ASL Dating makes NO representations, warranties, or guarantees of any kind, express or implied, regarding the safety, character, criminal history, marital status, sexual history, or intentions of any user
YOU ASSUME THE ENTIRE RISK of any communication, meeting, or interaction with another user, on or off the Service, including all consequences thereof.
## ⚠️ 13. Criminal Acts and Misconduct by Other Users
ASL DATING SHALL NOT BE LIABLE — under any theory of law including negligence, gross negligence, strict liability, premises liability, breach of contract, breach of warranty, or otherwise — FOR ANY CRIMINAL ACT, TORT, OR HARM COMMITTED BY ANY USER OF THE SERVICE AGAINST YOU OR ANY OTHER PERSON, WHETHER OCCURRING ON OR OFF THE PLATFORM. This includes, without limitation:
- Sexual assault, rape, attempted sexual assault, sexual battery, or any other form of sexual violence
- Sexual harassment, unwanted sexual advances, or transmission of explicit content without consent
- Stalking, cyberstalking, harassment, intimidation, or unwanted contact
- Physical assault, battery, kidnapping, false imprisonment, or any attempt or threat of physical violence
- Murder, attempted murder, manslaughter, or any death — including by suicide — arising from interactions originating on or facilitated by the Service
- Domestic violence, intimate partner violence, coercive control, or any abuse
- Identity theft, financial fraud, romance scams, catfishing, or any deceptive scheme intended to obtain money, goods, services, sexual content, or other things of value from you
- Theft, robbery, blackmail, sextortion, extortion, or coercion
- Child abuse, child sexual abuse material, exploitation of minors, or any violation of child protection laws
- Human trafficking, sex trafficking, labor trafficking, or solicitation of prostitution
- Distribution of intimate images without consent, "revenge porn," non-consensual recording, or unauthorized screenshots
- Doxxing, swatting, or coordinated harassment campaigns
- Defamation, libel, slander, or false statements made by another user about you or any third party
- Transmission of viruses, malware, ransomware, phishing, or other malicious software
- Transmission of sexually transmitted infections, communicable disease, or any other physical harm
- Any other criminal conduct, civil tort, or harmful act of any kind, named or unnamed
YOU UNDERSTAND THAT MEETING WITH OR INTERACTING WITH OTHER USERS — WHETHER IN THE APP, BY MESSAGE, BY VIDEO CALL, OR IN PERSON — INVOLVES INHERENT RISKS, INCLUDING THE RISK OF SERIOUS BODILY HARM OR DEATH, AND YOU ACCEPT THOSE RISKS IN FULL.
ASL DATING IS NOT A GUARDIAN, CHAPERONE, GUARANTOR, OR INSURER OF YOUR SAFETY. The existence of safety features within the Service (reporting, blocking, suspension, auto-suspend, safety alerts, etc.) does not create any legal duty of care, common-law obligation, or contractual promise to protect you.
IF YOU ARE THE VICTIM OF A CRIME, CONTACT LOCAL LAW ENFORCEMENT IMMEDIATELY. ASL Dating will cooperate with valid law enforcement requests but is not your representative, advocate, or legal counsel.
## 💜 14. Mental Health, Emotional Distress, and No Professional Advice
The Service is a social platform, not a mental-health, medical, legal, or financial resource. By using ASL Dating, you acknowledge:
- ASL Dating is not a substitute for psychotherapy, counseling, mental-health treatment, addiction treatment, relationship counseling, marriage counseling, or any other professional service
- Nothing communicated through the Service — by ASL Dating, by other users, or by any tutorial, tip, in-app notification, or marketing material — constitutes medical, psychological, legal, financial, immigration, or relationship advice
- Online dating can carry significant emotional risks, including but not limited to rejection, ghosting, breakup, jealousy, anxiety, depression, isolation, body-image concerns, addiction-like usage patterns, or other negative emotional states
- ASL Dating shall NOT be liable for any emotional distress, mental health deterioration, suicidal ideation, suicide, suicide attempt, self-harm, eating disorder, substance abuse, or other psychological harm arising from or related to your use of the Service or interactions with other users
- If you are experiencing a mental health crisis, contact a licensed mental health professional or, in the United States, dial or text **988** for the Suicide & Crisis Lifeline. Outside the U.S., contact your local crisis service
## 🌪️ 15. Force Majeure and Events Beyond Our Control
ASL Dating shall not be liable for any failure or delay in performance, service interruption, data loss, account loss, or other harm arising from circumstances beyond its reasonable control, including:
- Acts of God, natural disasters, earthquakes, hurricanes, tornadoes, floods, fires, storms, or pandemics
- War, terrorism, civil unrest, riots, insurrection, or government action including bans, sanctions, or regulatory shutdowns
- Failure or interruption of telecommunication networks, internet service providers, satellite networks, electrical power, or other utilities
- Failure of third-party service providers including but not limited to Twilio, Supabase, Apple, Google, Amazon Web Services, Cloudflare, Stripe, RevenueCat, or any other vendor or partner
- Cyberattacks, distributed denial-of-service (DDoS) attacks, ransomware, supply-chain compromises, or any malicious third-party action
- Labor disputes, strikes, or work stoppages — whether involving ASL Dating or its vendors
- Changes in applicable law, regulation, or court order that prevent continued operation of the Service in any jurisdiction
During any such event, ASL Dating's performance obligations are suspended without liability, and ASL Dating may at its sole discretion suspend, modify, or terminate the Service.
## ✍️ 16. Your Representations and Warranties
By creating an account and using the Service, you represent, warrant, and covenant to ASL Dating that:
- You are at least 18 years of age and of legal capacity to enter into a binding contract
- You are NOT subject to any restraining order, protective order, no-contact order, or other court order that prohibits you from contacting another person or using dating services
- You are NOT impersonating any other person, living or deceased, real or fictional, and you are NOT using the Service on behalf of any other person without their authorization
- The phone number you provided belongs to you, and you are authorized to receive SMS messages at that number
- All photographs and videos you upload depict only yourself and were created with your knowledge and full consent; you own all necessary rights to upload and display them
- You will not use the Service for any commercial purpose, including dating-app coaching, escort services, sex work, multi-level marketing, drop-shipping, cryptocurrency promotion, or any other commercial solicitation
- You will not violate any law or regulation in your jurisdiction or any jurisdiction in which the other user is located
- Your use of the Service does not violate any contract, court order, employment agreement, or other legal obligation to which you are subject
Breach of any of these representations constitutes a material breach of these Terms and may result in immediate termination of your account, civil liability, indemnification obligations under §6, and/or referral to law enforcement.
## 🤝 17. Release of Claims and Covenant Not to Sue
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, you hereby IRREVOCABLY RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE ASL Dating, ASL Dating LLC, and their respective parents, subsidiaries, officers, directors, employees, agents, affiliates, contractors, licensors, partners, successors, and assigns (the "Released Parties") from any and all claims, demands, damages, actions, causes of action, suits, judgments, costs, attorney's fees, and expenses, of any nature whatsoever, whether known or unknown, suspected or unsuspected, foreseen or unforeseen, arising out of or in any way related to:
- Your use of, or inability to use, the Service
- Any communication, interaction, meeting, relationship, or transaction with another user, on or off the Service
- Any criminal act, tort, civil wrong, or harm committed by another user against you, regardless of whether the other user's conduct was foreseeable, was reported, or had been the subject of prior complaints
- Any decision you make as a result of using the Service, including decisions to meet in person, exchange contact information, share resources, marry, cohabitate, or have children with another user
- Any data breach, hack, or unauthorized access to the Service, your account, or your data
- Any failure of the Service's safety features (reporting, blocking, suspension, auto-suspend, etc.) to prevent or mitigate harm
- Any decision by ASL Dating to act, or not act, on a user report
You expressly waive the protections of California Civil Code §1542 and any similar law in any other jurisdiction, which provides: *"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."*
This Release applies to claims of every kind, including but not limited to negligence, gross negligence, recklessness, breach of contract, breach of warranty, breach of fiduciary duty, fraud, misrepresentation, products liability, premises liability, and statutory claims under any consumer-protection or safety law.
This Release survives termination of these Terms and your account indefinitely.
## 📜 18. General Provisions
- **Severability.** If any provision of these Terms is held unenforceable, illegal, or void by a court of competent jurisdiction or arbitrator, that provision shall be severed, modified to the minimum extent necessary to be enforceable, or both, and the remaining provisions shall continue in full force and effect
- **Entire Agreement.** These Terms, together with the Privacy Policy and Community Guidelines, constitute the ENTIRE agreement between you and ASL Dating and supersede all prior agreements, representations, marketing materials, and understandings, whether written or oral, regarding the Service
- **No Waiver.** ASL Dating's failure or delay to enforce any provision of these Terms shall not constitute a waiver of that or any other provision. No waiver is effective unless in writing and signed by an authorized officer of ASL Dating LLC
- **Waiver of Jury Trial.** TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND ASL DATING EACH IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY in any proceeding, lawsuit, or arbitration arising out of or related to these Terms or the Service
- **No Third-Party Beneficiaries.** These Terms are for the sole benefit of you and ASL Dating, and no third party — including other users, family members, heirs, or assigns — shall have any rights, claims, or causes of action under these Terms
- **Assignment.** ASL Dating may assign or transfer these Terms or any rights or obligations under them at any time, without notice and without your consent. You may NOT assign or transfer these Terms or any rights or obligations under them, in whole or in part
- **Electronic Signatures and Communications.** By tapping "I Agree & Continue" or otherwise accepting these Terms, you (a) consent to receive all communications from ASL Dating in electronic form, (b) agree that all electronic agreements have the same legal force as wet-signed paper documents, and (c) waive any right to require ASL Dating to deliver communications in non-electronic form
- **Headings.** Section headings, icons, and numbering in these Terms are for convenience only and have no legal or contractual effect
- **Survival.** All provisions of these Terms that by their nature should survive termination — including but not limited to ownership, warranty disclaimers, indemnification, limitations of liability, releases, dispute resolution, governing law, statute-of-limitations limits, no-class-action waiver, and these General Provisions — survive termination of your account and these Terms indefinitely
- **Notices.** ASL Dating may provide notice to you by posting in the Service, by in-app notification, or by SMS to your verified phone number. Such notices are deemed received when posted or sent. You may not provide effective legal notice to ASL Dating except by email to **legal@asldatingapp.com**, and only legal notices to that specific address are deemed received
- **Statute of Limitations.** You acknowledge and agree that any claim or cause of action against ASL Dating must be filed within ONE (1) YEAR of the event giving rise to the claim, regardless of any longer statutory limitations period that might otherwise apply, and any claim brought after that period is permanently waived
- **No Class, Collective, or Mass Actions.** You and ASL Dating each waive any right to participate in a class action, collective action, mass arbitration, multi-claimant arbitration, consolidated arbitration, or representative proceeding of any kind. Any dispute must be resolved on an INDIVIDUAL basis. If a court or arbitrator determines that this waiver is unenforceable as to any particular claim, that claim shall be severed and resolved separately, but the remainder of the dispute resolution provisions shall remain in effect
- **Interpretation.** These Terms are not to be construed against ASL Dating as the drafter; both parties have had the opportunity to review and seek independent legal counsel
## 🛑 19. Service Discontinuation, Modification & No Refund on Shutdown
ASL Dating, ASL Dating LLC, and any successor entity reserve the absolute, unconditional, and unilateral right to modify, suspend, discontinue, or permanently shut down the Service — in whole or in part, in any market, at any time, with or without notice, and for any reason or no reason. By using the Service, you expressly acknowledge and agree:
- **No guarantee of continued availability.** ASL Dating makes NO promise, warranty, or representation that the Service will continue to be offered for any particular period of time, in any particular jurisdiction, or with any particular features or functionality
- **Reasons for shutdown may include, without limitation:** business decisions, lack of profitability, acquisition, merger, divestiture, dissolution, bankruptcy, insolvency, regulatory action, legal claims, infrastructure failure, loss of key vendors, or any other reason — disclosed or undisclosed
- **NO REFUND ON SHUTDOWN.** If the Service is discontinued — whether for the entire user base or only in your market — and your subscription or one-time purchase has not yet been fully consumed, YOU ARE NOT ENTITLED TO ANY REFUND, PRO-RATA CREDIT, REIMBURSEMENT, OR REPLACEMENT, in whole or in part, from ASL Dating LLC, its successors, or its affiliates. This applies to all paid features, including but not limited to Premium subscriptions, Unlimited Super Likes monthly subscriptions, and Super Like packs
- **Apple / Google refunds.** Subscription refunds are handled solely under the Apple App Store and Google Play refund policies. ASL Dating does not control, influence, or guarantee any decision by Apple or Google to grant or deny a refund
- **Bankruptcy or insolvency.** If ASL Dating LLC files for bankruptcy, becomes insolvent, dissolves, or otherwise ceases to operate, you waive any and all claims against the company, its officers, directors, employees, agents, and affiliates for unconsumed subscription value, one-time purchases, account balances, or any other monetary remedy. Any claim you may assert in a bankruptcy proceeding is subject to the priority and pro-rata distribution rules of the applicable bankruptcy court — ASL Dating LLC does not guarantee any recovery
- **Acquisition / merger / asset sale.** If ASL Dating LLC, the Service, or any user data is acquired by, merged with, or sold to a third party, this Agreement (including all liability waivers, releases, and disclaimers) binds the successor entity and survives the transaction. Your continued use of the Service after such transaction constitutes acceptance of the successor's operation of the Service under these Terms
- **Data export before shutdown.** If commercially feasible and not prohibited by law or contract, ASL Dating will use reasonable efforts to provide affected users a window of at least 14 days prior to permanent shutdown during which users may request export of their personal data. ASL Dating is NOT obligated to do so and shall not be liable for failing to provide notice or an export window if circumstances (including but not limited to insolvency, regulatory action, or vendor failure) prevent it
- **Modification of features, pricing, or limits.** ASL Dating may add, remove, change, or re-price any feature of the Service — including the daily-Super-Like cooldown, free-tier match limit, Premium feature set, subscription pricing, or any other parameter — at any time, with or without notice, and without liability. Continued use after such change constitutes acceptance
- **No data portability obligation post-shutdown.** Once the Service has been permanently shut down, ASL Dating has no obligation to maintain, host, transfer, or restore any user data, even in response to a subsequent legal request, court order, or subpoena. Data may be permanently destroyed in the ordinary course of wind-down operations
YOU ACCEPT THE FULL RISK that the Service may become unavailable at any time and that you may lose access to your account, photos, videos, conversations, matches, and any unconsumed paid features, with NO COMPENSATION OR REMEDY OF ANY KIND from ASL Dating, its officers, directors, employees, agents, affiliates, successors, or assigns. This Section survives termination of these Terms.

These Terms are governed by the laws of the United States and the State of Utah, without regard to conflict-of-law principles. For legal matters or questions:
